Underwater lights and noise regulations for superyachts in the South of France

The South of France is a popular destination for yacht owners and enthusiasts, with its stunning coastline and vibrant culture. As much as 75% of the global yacht charter industry’s business happens in the South of France and Corsica during the Mediterranean summer season. However, it’s important for captains, charter agents and management companies to respect the various local environmental laws in place.

As well as regulations around anchoring in an effort to protect Posidonia seagrass, local provisions have been implemented to restrict the use of underwater lights and limit noise pollution to minimise disturbance to the marine environment (decree 172/2021).

Underwater lights restrictions

According to the decree implemented by the French government, the lighting of vessels in the South of France and Corsica should be limited to what is strictly necessary. In order to minimise light pollution, the loss of navigation markers, and the disturbance of marine fauna and flora, underwater lights are prohibited three hours after sunset, and the use of any light source that is not essential for navigation and life on board is forbidden. These provisions do not apply to professional fishing vessels using authorised light sources.

Noise restrictions

In the same decree, it states that noise levels on board yachts must be kept to what is considered a ‘normal’ level. An abnormal level is considered to be any noise produced by recreational activities within three nautical miles of the shore that causes disturbance to other vessels, public peace, and the marine environment. This provision includes noise that is produced by loud speakers and other amplified sounds.

Other restrictions

The decree also includes regulations relating to the use of fireworks and approaching marine mammals:

• Fireworks fired from the sea must have prior approval from the maritime authorities
• Voluntarily approaching marine mammals (such as dolphins) within 100 metres (328 feet) is strictly prohibited

To ensure compliance with the regulations, captains, charter agents and management companies should familiarise themselves with the local laws prior to entering French waters.
